Board of Ed's Homeless Public Charter School

Today's word of the day is DEED.


Imagine sending your kids to a public school with no classrooms! A virtual school! A school without walls!


Well that is exactly what the Montgomery County Board of Education has planned for their very first public Charter School.  The Board of Education has approved the Community Montessori Charter School to open August 27, 2012, without a school building.


Community Montessori wants to use space in the old Pleasant View Elementary School in Wheaton.  But they have no legal right to occupy that building. The old Pleasant View Elementary School property is owned by Montgomery County under a restricted deed from M-NCPPC that says that the property will be used "only for the purposes related to the Pleasant View multi-family housing development".  


If Montgomery County decides the property is not needed for Pleasant View multi-family housing anymore, the property reverts back to M-NCPPC.

  1. This would explain why the Board of Education decided there won't be any school buses for these children. Hard to bus kids to a school that has no classrooms.

  2. This deed is not be for the property that the Pleasant View school sits on. If you look up the tax ID in the Maryland SDAT system, you can see a map of the parcel. You can also see that this property is currently owned by MNCPPC, not by Montgomery County, so there may be a subsequent deed returning the property to MNCPPC.

    The deed is for the parcel labelled P193 on the map. Aligning that map with a Google satellite map shows that the parcel is question is the soccer field in Pleasant View park; this is consistent with the street address being College View Drive. The property is close to the school property, but it's separated by an additional parcel P241.     According the site plan in the mandatory referral document at http://www.montgomeryplanningboard.org/agenda/2012/documents/20120621_PublicCharterSchoolFinalStaffReport_000.pdf, the school occupies parcels P241 and P270.

    1. If what you are saying is true, then Crossway still has ZERO right to the school building. This deed sets property to be used as housing. If there is no housing on this property, then there is no Crossway running a housing project. Your point seems to be that the above Deed is in error as it deeded a vacant lot as a housing project?

      The Pleasant View property is made up of multiple parcels. Montgomery County leased the property to HOC for housing. HOC hired Crossway to run the housing program.

      If the parcel designations are off, that doesn't change the fact that Crossway has NO RIGHT TO OCCUPY the structure on this land. They are vendors, not owners. That was made clear in the Park and Planning hearing by the Crossway attorney.

      If this Deed is for the wrong parcel and the other parcel was not transferred for housing, then that changes the ownership information. But, it's not clear that any of the property owners are paying attention.

      If you look on the SDAT sheet and the Deed reference above, you will see that this is indeed for P241.

      The Deed reference on the SDAT sheet is L.8712 F.192 which was executed on 2/7/1989.

      That Deed only amended the acreage of the Parcel conveyed. All of the restrictions as stated in the original Deed, found at L.8446 F.520 and posted above, remained in place.

      SDAT only tells part of the story.

  3. This is definitely an interesting thread, however, I think you are all confusing Montgomery County with some kind of place where laws are followed. No matter what happens, and what the legal issues are, unless the citizens here speak up, the county's various government agencies will do as they please. As an aside, the state AG is from Montgomery County.
