Union, MCPS reach agreement for pay for paras, part-time workers

SEIU Local 500, the union representing school district paraprofessionals and part-time workers, including custodians and bus drivers, reached an agreement with MCPS on Wednesday to provide pay to its members during the statewide schools shutdown.
In a message posted to the SEIU website, President Pia Morrison wrote that no union members will be required to work on-site during the shutdown, except “in the case of emergency or unforeseen circumstance.”..

Officials in Maryland's Montgomery County gave unionized workers — and themselves — big raises. Now they can't afford them.

Government-workforce politics have gotten very interesting in Maryland's Montgomery County, which includes a number of affluent Washington, D.C., suburbs. Unions are unhappy because their negotiated pay raises were unilaterally trimmed by the county council and because one council member has proposed changing the county's collective-bargaining laws in ways that don't sit well with labor. Meanwhile, homeowners are unhappy because of the biggest property-tax hike in seven years.
When you sort it all out, one-party government might just be a big part of the problem.
As chronicled in the Washington Post, the $5.3 billion budget the council approved in May included a nearly 9 percent property-tax hike that adds $326 annually to the average residential tax bill. The budget also increased a tax on recording real estate transactions that raises the cost of buying or selling a $500,000 house by $455....

BOE 2 Hour Closed Session Friday to Discuss Collective Bargaining Negotiations

The Board of Education of Montgomery County will conduct a closed session on June 10, 2016, in Room 120 of the Carver Educational Services Center, 850 Hungerford Drive, Rockville, Maryland, from 3:00 p.m. to approximately 5:00 p.m

The Board of Education will receive a briefing by staff and discuss ongoing collective bargaining negotiations and matters that relate to the negotiations.

Montgomery Council calls for reduction in wage in negotiated wage hikes


...Leggett and the Board of Education have until May 10 to renegotiate wage provisions with unions and send a revised package back to the council. Leggett and the board could also opt to leave the increases unchanged.
The council has the authority to set pay. It is scheduled to take final action on the budget May 26...

Vote No on Secret Budget Meetings

Tomorrow Montgomery County voters will have the chance to vote whether or not they want the Montgomery County Public Schools (MCPS) budget set in public by the Board of Education or behind closed doors by a secret committee.

Maryland law calls for the MCPS budget to be set by the Board of Education in a public process, but that hasn't happened in the last decade. Click here to read how the MCPS budget used to be formulated.

The Parents' Coalition documented the existence of the MCPS backroom, secret budget committee in March of 2012 when we made public Agendas that were obtained through a Maryland Public Information Act request. You won't find these documents on the MCPS website.  

We know that participation in these backroom budget meetings requires the participants to sign confidentiality agreements.  Yes, the people that set the MCPS public school budget sign that they will keep the MCPS budget setting process a secret. Yes, it's a public budget funded from public dollars, but the participants in this backroom meeting don't think you should know what they discuss.

We know that all three unions, MCPS administrators and MCCPTA participate in these backroom budget meetings. There are no Board of Education members or representatives of the public permitted in the room for these meetings.

It's your choice.  The Apple Ballot candidates support the backroom, secret budget process that sets the MCPS budget without any community input or public process. Those are the candidates that will support this continuing violation of Maryland law.

Vote for the Apple Ballot to support the continuation of the backroom, secret budget meetings.

Vote to return the MCPS budget to the Board of Education table for a public budget process by choosing non-Apple Ballot candidates.

Easter Monday: MCPS Union will get 2 and 1/2 times hourly rate

The Board of Education and Superintendent are going to have to pay SEIU members who work on Easter Monday time and one-half according to the SEIU contract.  That will make running school on that date more expensive than a regular school day.  

If, after having established the calendar for the school year (including the 
designation of official holidays), (a) the Board changes the school calendar and 
the Board removes the designation of holiday from a day designated as an official 
holiday; and (b) bargaining unit employees are required to work on the 
previously-designated holiday due to the change in the calendar, the bargaining 
unit employees required to work on that day shall be entitled to the pay for 
Holiday Work described in this Article 9, Section C, and bargaining unit 
employees on authorized paid leave for that day shall be considered to be on 
Holiday leave, as defined in Article 12, Section G.

Holiday Work 
1. A unit member required to work on an official Board of Education holiday 
(and/or Christmas and New Year's Day when such days fall on a weekend) shall 
be paid one and one-half times the basic hourly straight time rate for each hour 
worked in addition to the holiday pay to which he/she is entitled.

3 Unions finally settle on contracts with Board of Education


The 3 Unions have finally settled on contracts.  On March 21, 2013, the Board of Education will Approve these 3 contracts.  What do these new agreements demand? The public has no idea as these negotiations are held in secret.  We don't get to see the agreements in advance of the BOE approval. The BOE will not discuss the details of these documents prior to voting on them.

Union Demands Continue Even as BOE Set to Adopt FY 2014 Budget

At today's Board of Education meeting, the Closed Session Agenda shows that the Union contracts for FY 2014 have not been finalized.
...Resolved, That the Board receive a briefing by staff and discuss ongoing collective bargaining negotiations and matters that relate to the negotiations...
The Board of Education is also set to adopt the FY 2014 Operating Budget today.

How can the Board of Education be approving the FY 2014 Operating Budget when the contracts with the unions have not been finalized? Why are negotiations ongoing? Shouldn't that be an Open Session discussion?

MCPS Class Sizes and School Staffing for 2012-2013

Below is the Class Size and School Staffing budget document for the 2012-2013 school year.
The yellow highlighting shows changes from the 2011-2012 budget document.  
Read the 2011-2012 document at this link.

For example, in the box for Classroom Teacher under Elementary Guideline we see that the following sentence has been added to the 2012-2013 staffing guidelines: 
"When numbers support it, positions are allocated for combination classes."
There are many other changes to the document that will reduce or change the number of staff at local schools next year.  There are also more instances where staffing is at the discretion of the local principal, and a number of positions do not give the details of actual allocations. 


Remember that this document is prepared at the secret budget table by MCPS administrative staff, the 3 Unions, and MCCPTA select officers. This document is not prepared at the public Board of Education table by the elected Board of Education.

Board adds $232K in Union Liaison Positions Since 2006

Since 2006, the Montgomery County Board of Education added two new union liaison positions to the MCPS operating budget.  Total in salary alone (no benefits) for these two new positions is $ 232,627.04.  


Please note that this information is coming out of the MCPS Operating Budget for 2010.  This is not salary information from a union budget.  A choice has been made by the secret budget committee to fund these positions out of the MCPS Operating Budget over, for example, classroom teacher positions. The unions and MCCPTA all sit at the secret budget table.

MCPS Staff to get 2 hours of personal leave day before Thanksgiving

This e-mail message has been approved for distribution by Mr. Larry A. Bowers, chief operating officer. No hard copy will be provided. 
To recognize and thank staff for their commitment to our students’ success, Montgomery County Public Schools (MCPS) and the three employee associations have agreed to release employees two hours early on Wednesday, November 23, 2011, the day before Thanksgiving. You will not be required to use your leave. 
If you are unable to leave your work location early, you will be credited with personal leave. If you are normally scheduled to work more than four hours that day, you will receive two hours of personal leave; if you are normally scheduled to work four hours or less that day, you will receive one hour of personal leave. If you are unable to leave early, you must inform your principal or supervisor.  
If you are responsible for Interagency Coordinating Board (ICB) activities occurring after 5:00 p.m. or if you are a Department of Transportation school bus operator or attendant, you will be credited with personal leave.If you are on leave that day, you will be charged for your leave and will not be credited with any additional leave.  
MCPS and your employee associations have worked out the implementation guidelines and distributed a memorandum to administrators and directors who will ensure that the provisions are implemented.  Any questions about how this provision will affect you may be addressed to your principal, director, or supervisor at your work site.

Starr: Week 2, Trip 1

What does a superintendent do the second week of a new gig? Why travel out of town, of course! 


Here's video of Superintendent Joshua Starr, at his very first Board of Education meeting for MCPS, announcing that the next week he will be traveling to Boston with the Board of Education President Christopher Barclay, unnamed "senior staff" and unnamed union leaders. 


How many attended and at what cost to taxpayers? 


Well we know that attendance at the Harvard Public Education Leadership Program event is pricey (tuition $4,600). But we don't know about food, lodging and transportation. 


Remember that Superintendent Starr sits on the board of one of these Harvard education projects.

...In Montgomery County, stable leadership with a superintendent who has been in the position for 12 years has helped foster a collaborative culture. The Montgomery County Education Association (MCEA) worked with MCPS to develop three Professional Growth Systems (PGS) for teachers, administrators and support professionals. In April 2010, MCEA and MCPS signed an agreement to use student performance data in evaluations. 
A shared sense of leadership also helps. “You have to distribute the leadership. You can’t just distribute the responsibility,” added Weast. “Authority and responsibility have to go together. You have to defuse the governance.”..

2008: Unions are permanent members of [MCPS] leadership team


Bringing Unions into Management: 
Montgomery County. Jerry Weast’s initial description of MCPS as a school system divided into two separate and unequal districts — a Red Zone of poverty, color and low achievement and a Green Zone of affluence and high achievement — led directly into “Our Call to Action,” which was designed to mobilize both the district and the community to embrace all students and ensure that achievement would not be predictable by race. This same call to move across boundaries and develop shared responsibility for all students went out to the three employee unions. Beginning as collaboration and building on the district’s earlier move to interest-based bargaining, it resulted in a restructured governance process. The three unions were invited to participate in the district’s capital and budget planning process. To ensure all voices were heard, the superintendent also invited administrators to form a fourth union to participate on equal footing with the others. Once the initial planning processes were completed, the heads of the teachers’ and administrators’ unions became permanent members of the district’s leadership team. The resulting decision-making structure has allowed MCPS to cross vertical
and horizontal boundaries within the organization, speak with a consistent voice and model a culture of shared responsibility.

MCEA: "We formulate the budget, we know where the money is..."

...Five years ago, the district [MCPS] created a budget committee, half of whose members belonged to unions. Last year, when Larry Bowers, the district’s [MCPS'] finance director, said the schools could not afford a scheduled 5.3 percent raise, the teachers’ union agreed. “Saved us $89 million,” Mr. Bowers said. 
Mr. Prouty, the union president, said he knew Mr. Bowers was telling the truth. “We formulate the budget; we know where the money is, which makes us much more trusting,” said Mr. Prouty, whose members also agreed to forgo a raise next year.

Weast thanks secret budget committee for "hundreds of hours" of work

In a May 23, 2011 memorandum to the Board of Education Superintendent Jerry Weast thanked the people that put together the MCPS budgets. 


No, he didn't thank the Board of Education, he thanked the people at the secret budget table. 


You know them, right? Oh, no? True, the meetings are secret and the public can't observe the discussions. The budget meetings are so secret even school staff don't know when their positions are on the chopping block.


Here's Superintendent Weast's statement:
From the beginning of the process, representatives of each of the employee associations (the Montgomery County Education Association, the Montgomery County Association of Administrators and Principals, and the Service Employees International Union (SEIU) Local 500) and leaders of the Montgomery County Council of Parent Teacher Associations (MCCPTA) participated in all of the budget development meetings. They spent hundreds of hours reviewing every proposal and alternative...Executive leadership and many other staff members also played an essential role in providing information and developing new ideas to advance the budget process.

Union reps keep budget discussions from membership


Notes from a meeting of MCEA (Montgomery County Education Association) and SLMP (School Library Media Program): 
"Administrators have been advocating for flexibility in making many decisions for their buildings, including staffing decisions.  In this case, the decision to give elementary principals the flexibility to make cuts that included media specialist positions came approximately two weeks before that decision became public
knowledge.  Nothing was finalized at that time. Until decisions are final, they must remain confidential to minimize rumors and misinformation that can arise.
Therefore, MCEA representatives could not inform media specialists in advance."
Thus, Media Specialists had no opportunity to advocate for their positions before a final decision was made. That's how the MCPS Secret Budget Table works. Those select few at the table keep all budget discussions confidential to prevent any public discussions of decisions being made. 


Who's at the MCPS Secret Budget Table? Union reps, MCCPTA and MCPS staff is all we know. When does the group meet? No clue. Public minutes of meetings? None. Public input into budget discussions? Zero.
