Montgomery County unlawfully denied stormwater management tax credits to property owners in a Gaithersburg business park because the development’s ponds for handling runoff were not located on their individual properties, the Maryland Tax Court’s chief judge ruled Wednesday.

This ruling means that homeowners who live in a subdivision that has a stormwater management facility that is maintained by their HOA are entitled to a reduction or even elimination of WQPC charges on their property tax bills. HOA boards should take note of this ruling and let their members know that they should request a refund of recent WQPC fees and removal of WQPC fees from future tax bills.
