Judge dismisses discrimination suit over Montgomery’s magnet schools

A lawsuit alleging Maryland’s largest school district discriminated against its Asian American students after it changed its magnet program admissions process has been dismissed by a federal judge.

U.S. District Judge Paula Xinis concluded in the dismissal last week that the complaint failed to show that Montgomery County Public Schools’ revision to its admissions process at the start of the pandemic “disparately impacts Asian American students or had been implemented with discriminatory intent.”

Two years ago, the Association for Education Fairness, a parent group, filed complaints against the school system arguing that it unlawfully used race as a factor in admissions in its efforts to increase racial diversity in magnet programs with revisions made before the 2018 school year...

Board of Education: The school board also argued that there is no law establishing a duty for school staff members to intervene to protect students from alleged police misconduct.


...In a separate court filing, the Montgomery County Board of Education asked that allegations that school staff members were negligent and violated the boy’s rights be dismissed.

The board argues that, although the child exited the school, he was in the presence of the assistant principal and was supervised.

The lawsuit alleges that Pfeiffer, the assistant principal, was within feet of the boy when police arrived...

In lawsuit, family says MCPS special education student was assaulted 11 times in one year


...The boy was placed in a “self-contained classroom,” according to court documents, with other students receiving special education services. Each student in the class was supervised and assisted by a one-on-one aide, according to the lawsuit, filed Tuesday in Montgomery County Circuit Court.

On at least 11 occasions between May 2017 and April 2018, the student was allegedly attacked by a fellow student or students, court documents say.

“The child was entitled to protection and being safe in school. That’s where the school completely, utterly failed in this case,” attorney David Ledyard, who is representing the family, said in an interview.

Three MCPS spokespeople did not respond to an email seeking comment on Wednesday, including questions about how the student was injured...

Family sues MCPS after son fractures skull in fight at Magruder High

The family of a Col. Zadok Magruder High School student is suing the school system after he sustained a fractured skull and was hospitalized for several days after a fight last year.
On Feb. 12, 2019, then-freshman Jacob Van Dyken was involved in a fight with a classmate. The fight — which was recorded by several students who had gathered around the duo to watch — resulted in Van Dyken spending several days at Children’s National Medical Center. He had a fractured skull and at least one blood clot, according to reports from his family.
The family alleges school officials did not call an ambulance for Van Dyken, even though he showed “obvious” signs of trauma, including bleeding from the head and vomiting. Van Dyken had also defecated and urinated on himself as a result of the head injury, according to court documents...
