***BREAKING: New Charges filed on former MCPS Cloverly Elementary School Teacher John Vigna

Please see our previous extensive coverage of the arrest, conviction, vacated conviction, and re-trial of former MCPS elementary school teacher John Vigna. Recall that Mr. Vigna was never fired by the Montgomery County Board of Education and his teaching license was never revoked.  He was allowed to retire and voluntarily surrender his teaching license. His original conviction was vacated and he was released from prison.  A new trial on those charges has been scheduled for 2024.  Now additional charges have been filed against Mr. Vigna.  

New charges were filed against Mr. Vigna on November 30, 2023.

Open Letter to the Montgomery County Board of Education:

It has been just over a week since the passing of Dr. Lani Guinier, the heralded African American female attorney whose innovative and provocative writings on racial justice and voting rights were used to undermine her nomination to lead the Justice Department’s Civil Rights Division. Today, we are witnessing a similar political attempt to destroy another professionally qualified woman of color, Dr. Monifa McKnight. She is being strategically and unjustly vilified during her candidacy to be the next Montgomery County Public Schools Superintendent. We will not stand by and watch this happen again.  

We wish to call attention to the uneven and unfair treatment of Interim Superintendent Dr. Monifa McKnight, who answered the call to leadership amid the COVID-19 pandemic that has confounded governmental and private sector leaders to say nothing of school officials across the country. Constituent criticism is to be expected by any leader, but the potshots being taken against Dr. McKnight, by politicians who know all-to-well the complexities of balancing safety with public services, suggest an untoward motive at play. We are particularly aghast at leaders who purport themselves to represent marginalized communities of color and women taking part in these bad faith practices. 

The strategic and coordinated attack of some elected officials and affinity groups suggests an ulterior motive to negatively influence the selection of the next superintendent of schools. Interim Superintendent Dr. McKnight has the credentials, experience, and in-depth knowledge to compete for the position of Superintendent without internal and external influences that appear to be compromising the selection process.  

Specifically, the presidents of the Montgomery County Parent Teacher Association, Montgomery County Education Association, and the Montgomery County Association of Administrators and Principals, Council Member Tom Hucker, Board of Education Member Lynne Harris, and County Executive Marc Elrich appear to be engaging in back-door politics to publicly discredit the Interim Superintendent. We recognize this is an election year and that people join forces for self-interest, but there is never an acceptable time to target one individual for political gain. We demand that these persons and others stand down from further combative actions. 

The Board of Education members have a responsibility to model fairness and integrity for our children and students who are watching, the staff who are seeking direction, and the community that expects the core values of the school system to be carried out by its leadership. We recognize the difficulty in selecting a leader of such a large and diverse region and pray for the wisdom and fortitude of those tasked with making a decision that will impact so many families. 

We are resolute for a fully fair and just process that charts a way forward for all of Montgomery County, not merely the areas of privilege. Not only do we urge that Dr. McKnight’s candidacy is not tarnished in the eyes of the Board of Education, but that those who have acted in an unjust manner are held accountable. As leaders within this community, we believe it is our burden of responsibility to call out injustice, particularly in the wake of the Rev. Dr. Martin Luther King, Jr.’s Holiday who famously said, “Injustice anywhere is a threat to justice everywhere.”

WJHS Football Field is Full of #CRAP

FYI: Artificial turf football fields are supposed to look green. They are not supposed to look black.  When they look black it means that far too many tons of crumb rubber have been dumped on the field to take the place of the plastic grass.

Tons of extra crumb rubber means the field has failed and the playing surface is not safe. 

The blades of plastic are no longer able to hold the required depth of crumb rubber in place to prevent athletes from killing themselves when they hit the ground stone surface beneath the plastic.  The playing surface is no longer uniform or stable.

The Walter Johnson High School football field is being used by two football teams this season and there are no plans or funding to replace this field this year.  Students from all over Montgomery County will be risking their lives on this surface.

Environmental Waste Generated by Board of Education's Lust for Plastic Football Fields: The Turf Mountain



The Netherlands is a country of artificial turf. No country in the world has more artificial turf per capita. Last summer, over 200 artificial grass pitches were replaced in the Netherlands. No less than 1 million square metres of artificial turf had to be removed. All waste that cannot be dumped. What happens to the old pitches? What happens to all that plastic and all the polluting rubber in them? Processing companies promise to separate all the waste and recycle it. Municipalities pay top dollar for that. But what is the reality? Those involved call it 'the best kept secret in the market'. ZEMBLA follows the trail of a number of transports, and finds itself in a world of dealers, defrauding artificial turf processors, absent supervisors, and a growing artificial turf pile.

2009: FieldTurf Guaranteed RMHS Field would be 100% Recycled and Would Not End Up in a Landfill

What actually happened to the RMHS plastic grass.
In 2009, FieldTurf produced the letter below stating that the Richard Montgomery High School (RMHS) plastic football field and 120 tons of ground up tires (crumb rubber) would be 100% recycled and would not end up in a landfill.

In 2018, the RMHS plastic football field was removed and sent to a landfill in Southern Virginia and to a paint ball field in Baltimore County.

The RMHS plastic grass football field was not "100% recycled" and did end up in a landfill.

The Montgomery County Board of Education failed to have the RMHS plastic grass replaced under warranty when the field failed.  Instead, they diverted MCPS Operating Budget funds meant for public school classrooms to pay for the replacement of the RMHS plastic grass football field.  

The Montgomery County Board of Education failed to have FieldTurf honor their commitment to 100% recycle the RMHS plastic grass field.   They are polluting Southern Virginia and Baltimore County.  

These are the Board of Education members that are continually endorsed by major organizations, unions, other elected officials, and news organizations and elected and re-elected into office.  

The dumping and pollution from the removal of the RMHS plastic grass is their actual record in office.  

This is what Montgomery County voters support.

Do Electronic Devices in the Classroom Help?

Or are portables a distraction?

And does this impact only the student with the device?

Read the results from a Rutgers Study:

Students perform less well in end-of-term exams if they are allowed access to an electronic device, such as a phone or tablet, for non-academic purposes in lectures, a new study in Educational Psychology finds. 



Students who don't use such devices themselves but attend lectures where their use is permitted also do worse, suggesting that phone/tablet use damages the group learning environment.
Researchers from Rutgers University in the US performed an in-class experiment to test whether dividing attention between electronic devices and the lecturer during the class affected students' performance in within-lecture tests and an end-of-term exam.

12 tons of the used plastic field and crumb rubber have been sent to the Brunswick, Virginia landfill.

A 3rd dumpster has been filled with used artificial turf and crumb rubber at Richard Montgomery High School in Rockville, Maryland.  The artificial turf field was used for 10 years and now is being removed and at least 3 dumpsters of the used plastic and ground up tires is being sent to a landfill in Brunswick, Virginia despite assurances by the Montgomery County Board of Education that:

"The existing artificial turf material has been removed and sent for recycling."

Please note that two of these pictures were taken after the statement from MCPS COO Andrew Zuckerman saying that the old field had been sent for recycling.

Maybe MCPS COO will explain to the public what he means by "recycling" at this evening's Board of Education meeting.

Yesterday, we showed you the dumpster full of plastic artificial grass, ground up rubber tires, hay and plastic bottles at Richard Montgomery High School in Rockville, Maryland.

That dumpster showed that despite years of promises, the Montgomery County Board of Education and Montgomery County County Council were not going to recycle the artificial turf football field at Richard Montgomery High School.

Instead, at least 8 tons of the field are being sent to the Montgomery County incinerator in dumpsters.

But what happens when those dumpsters arrive at the Dickerson incinerator?  As we know from the September 26, 2011, Montgomery County Council hearing on artificial turf (the one where Councilmember Roger Berliner cut the video feed), artificial turf plastic grass is a "nonprocessable waste" (Page 86 of Power Point) and if delivered to the Dickerson incinerator will be sent to our out-of-state landfill in Brunswick, Virginia.

Not only is the RMHS artificial turf field not being recycled, at least 8 tons of it will permanently reside in the landfill in Brunswick, Virginia for centuries.  Artificial turf football fields are used for 10 years and take 1,000 years to decompose (or will never decompose) in a landfill.

You can take your grandchildren to visit the Brunswick, Virginia landfill and rehash the football, lacrosse, and soccer games that were played on the field during it's very short life at RMHS.  And while you are there you can also visit with the artificial turf fields from Blair HS, Wootton HS, Walter Johnson HS, Paint Branch HS, Gaithersburg HS, Whitman HS, BCC High School, Somerset ES and all the others to come.  They will all be there soon.

Board of Ed Sued Again on Procurement Issue: ABC7 - Judge reverses controversial decision on after-school care in Montgomery County #assault #sexabuse

POTOMAC, Md. (WJLA) — Farmland Child Development Center ran Potomac's Wayside Elementary after-school program in Montgomery County the past 27 years. But a new company bumped out the non-profit group when after-school care came up for bid this year: for-profit company Kids Adventures.
"I was shocked, honestly," said one father who requested anonymity with children still going to Wayside Elementary. “I couldn't believe that a provider that had a record like that was in business, let alone winning contracts.”

A Kids Adventure employee faces 50 years in prison, charged this April for allegedly assaulting and robbing a co-worker at a Takoma Park elementary school parking lot.

In a separate incident, an after-school care employee working with Kids Adventures pleaded guilty to sex crimes victimizing a 10 year old girl at another Potomac school.

Board of Ed. Used Money for NEW Artificial Turf Fields to Pay for RMHS REPLACEMENT Field

At this evening's Board of Education meeting MCPS Chief Operating Officer Andrew Zuckerman explained to the Board of Education that the money that was going to be spent for the replacement of the Richard Montgomery football field had already been approrpiated by the County Council. He said the money was coming from the Artificial Turf fund. 

Here is the Council's PDF form for the MCPS Artificial Turf Program (See page Circle 8)  The description of the fund is shown in the image below.  


The Artificial Turf Program was set up to fund the installation of NEW artificial turf at the 19 high schools that did not have artificial turf.

Richard Montgomery High School was the very first high school to have an artificial turf football field installed and is one of the six schools mentioned in the Description above.  

The Artificial Turf Program was not set up to fund the replacement of artificial turf fields.

If the Board of Education is using this fund to pay for the replacement of the RMHS field they are using funds that were appropriated for another purpose and they are taking away money meant to put in a new field at a high school that currently does not have an artificial turf football field.

However, the Board of Education has been quietly holding back revenue received from cell tower leases, field trip fees among other unknown sources of revenue and is now going to use those funds to pay for a new artificial turf football field at Richard Montgomery High School without bringing those funds to the County Council for appropriation.

**BOE Finds $562,721 for Plastic Grass at RM High School.** Not Money for Teachers, Classrooms, Lead Remediation, Mold Remediation, Repairs, Grass Seed... BOE Intentionally Let Warranty EXPIRE! Did Council Appropriate these Funds for this Purpose?

The Montgomery County Board of Education intentionally let the warranty on the defective Richard Montgomery High School artificial turf field expire and now they are going to use $562,721 of Operating Budget funds to replace this one plastic football field. 

The MCPS Real Estate department has been squirreling aways cash.  This money will be used to buy a new plastic field for Richard Montgomery High School.  Those funds are not listed in the MCPS Operating Budget documents in any discoverable location.  The image to the left shows the only mention of this fund in the FY19 MCPS Operating Budget.

Note that the Resolution (below) before the Board of Education on June 25, 2018, does not mention any approriation of these funds by the County Council.

The money in this "fund" has allegedly come in to MCPS through outside sources and is being immediately diverted to pay for plastic football fields without any discussion of the best use of these public school dollars. 

Probably the biggest source of cash for this fund is coming from Cell Tower revenue

That means that the high FARMS rate schools that have cell towers on their playgrounds and fields are paying for the plastic grass purchase at Richard Montgomery High School.  

In addition, MCPS has used Field Trip fees to fund Artificial Turf purchases

Remember that the actual Artificial Turf PLAN was that these fields would pay for themselves through field rental fees.  That has not happened. 

The Board of Education has not provided the public with an accounting for the funds being used to pay for the Richard Montgomery High School artificial turf field replacement nor are they bringing these outside funds before the County Council for appropriation. 

The failure to present a transparent budget Resolution to the public is on the Board of Education members four of whom are candidates in this year's elections.

Why did the Board of Education Spend $9,773 at the BWI Hilton in 1 Week Last Summer?

The Parents' Coalition has obtained Board of Education expense account records for calendar year 2017 through March 15, 2018.

Included in the documents we received are copies of the Board of Education's JP Morgan Chase credit card bills.

The July 31, 2017, Board of Education credit card bill shows three charges under the category of Travel activity from "Hilton Baltimore BWI" on three days in July with arrival dates of July 4, July 9 and July 11.   The total for these three transactions is $9,773.19.

What were these credit card transactions for?

Jill Ortman-Fouse Expenses Charged to MCPS Operating Budget = $10,895 .@Jill4allMoCo

For FY 2017 and FY 2018 through March, Board of Education member Jill Ortman-Fouse charged $10,895.25 in expenses to the MCPS Operating Budget.

The Parents' Coalition has obtained Board of Education expense account records for calendar year 2017 through March 15, 2018.

From the documents we obtained we believe the documents show that Ms. Ortman-Fouse traveled out of town on the following dates.

August 18 2017 - Possible Ocean City stay, but BOE members are not listed on the hotel bill

September 21, 2017 - Possible Ocean City stay, but BOE members are not listed on the hotel bill.

September 27-30, 2017 - Cube Conference in New Orleans, LA [Waldorf Roosevelt Hotel]

October 3-6, 2017 - 4 days at MABE Conference in Ocean City, MD

April 5, 2018 - Airfare purchased for unknown trip

Below are the records that we obtained.  Please note that Board of Education members no longer possess personal credit cards.  That practice ended in 2014 when the Parents' Coalition exposed how Board of Education members and their staff were using their personal MCPS credit cards.

However, Board of Education staff still have a MCPS credit card for Board member purchases.

MCEA Rally: Staff at Kemp Mill ES have been dismayed to see a bullying and ineffective principal turn their school into a place with one of the worst school climates in the county.

MCEA Rally Announcement:

Join parents, community members, and the Montgomery County Education Association at a rally at the MCPS Central Office to demand justice for the students and families at Kemp Mill Elementary School.

Kemp Mill has one of the highest percentages of children from low-income families in Montgomery County. It needs and deserves strong leadership. But for the past three years, educators there have been dismayed to see a bullying and ineffective principal turn their school into a place with one of the worst school climates in the county. 

The dedicated educators, paraeducators, and building service staff at Kemp Mill work every day to provide their underserved student population with the quality school community they deserve. After numerous attempts to raise these urgent concerns with the school district, we still have had no adequate response from MCPS. The Montgomery County educators' union will not stand idly by as MCPS does a terrible disservice to one of our high needs schools.

School’s out, but we’re just getting started! An injury to one is an injury to all, and only by coming together can we hold MCPS accountable to students, parents, and fellow educators. 

Superintendent Jack Smith continually says that “all means all,” but he needs to put action behind his words. Our most vulnerable students are suffering from his neglect. We must stand together to demand equity now. Join us at the rally to fight for the change that’s needed at Kemp Mill ES to improve the lives of our kids and our colleagues!

MCPS will be Responsible for Maintaining and Replacing Two Artificial Turf Fields at JWMS. MSI will be Out After Installation. $20K Annual Maintenance on Taxpayers.

At the City of Rockville Planning Commission meeting, MCPS staff revealed that once the two artificial turf fields are installed at Julius West Middle School the ongoing maintenance and eventual replacement of those fields will be the resonsibility of Montgomery County Public Schools. 

Remember that MCPS says the annual maintenance of an artificial turf field should cost $10,000.

That means that MCPS has found an extra $20,000 a year for each year going forward to spend on the Julius West Middle School fields. 

MCPS staff told the City of Rockville Planning Commission that they currently spend $0 on maintaining elementary and middle school fields. 

The MCPS-MSI Soccer deal has MCPS giving up 1,000 of field use per year and paying $20,000 a year to maintain the two fields at one middle school.

Who made this deal and why did the Board of Education approve it?






Surprise!! Julius West Middle School to Get Stadium Lights, Not Part of MSI Settlement and Surprise for Neighbors #steamrolling

At the June 12, 2018,  Board of Education meeting the Board of Education will vote to put in not one, but TWO artificial turf fields at Julius West Middle School.  The fields will be plastic grass with that "mystery" mineral substance infill that Board of Education members are not allowed to know about. 

And in the total surprise category, the Julius West Middle School plastic grass/mystery mineral fields will have stadium lights!  


Stadium lights were not mentioned in the MCPS - MSI Soccer settlement announcement.

The neighbors to the Julius West Middle School property have concerns about the introduction of stadium lights and are have expressed opposition to this project.

But who cares about the public!!!  Certainly not our elected Board of Education.  They have made a secret deal with MSI Soccer and that's the end of it!  The neighbors can just buy black out curtains and stay home during the evening so as to not put more traffic on the roads around Julius West Middle School!

The Board of Education vote is tomorrow.  Tune in to the BOE meeting to watch how our elected officials steamroll the public in an election year.
