Prince George’s County students challenge summer-school fees, fighting for free public education

When Laurie Tucker’s family moved during her son’s senior year of high school, she was sorry to hear the last two classes he needed weren’t offered at his new school during spring semester. Instead of graduating, he has to finish up in summer school.
An even worse surprise: The family will have to pay for those classes.
On Thursday, students sued the suburban Maryland school system where Tucker’s son attends class in a bid to lift summer-school fees.
Students shouldn’t be able to graduate only if they can afford to, said Tucker, whose son is one of the plaintiffs arguing the right to a free public education is guaranteed under the Maryland Constitution.
Tucker was shocked by the price for summer school in Prince George’s County: $225 per class, which will be a burden for her family. Her husband works as a driver delivering donations to nonprofit agencies, she said, to support their three children; she stopped working two years ago to care for their youngest child, who is 4 years old and has a disability.
Prince George’s schools spokeswoman Raven Hill said it is policy to not comment on pending litigation. But she confirmed the fees: $100 per half credit, with a $25 registration fee, for county students. Those who qualify for free- or reduced-price meals because of their families’ income levels are required to pay only half of those amounts.
Students from outside the county are charged more, $645 for a full credit plus the $25 registration fee. Hill said the fees are mainly to cover the cost of paying employees who don’t normally work over the summer...

Pay to Graduate in MCPS


  • The Board of Education has never authorized local schools to charge students a fee to graduate.

  • The Maryland State Legislature has never authorized public schools to charge students a fee to graduate. 

  • The money collected through "senior dues/fees" doesn't go in to the MCPS Operating Budget.  

  • The "senior fees/dues" charged at MCPS schools varies from zero to over $100.  

What exactly are these dues/fees being used for? 

Please note the "late fee." That adds a sense of urgency to this unjustified charge.

Thursday, December 23, 2010 is the last day to pay the senior fee at the low price of $45.00.  The price goes up after the winter break to $50.00.
Please submit your money or checks to XXXXX in the Media Center. 
Don't forget to write your students' name and ID number on the check.

Re:  Senior Cap and Gown fee
Dear Parents…The time is upon us to start planning for graduation.  Your senior student should have already filled out a cap and gown form and turned it in to XXXXXX in the XXXXX office.  Please note that cost for purchasing the cap and gown is separate from the announcements and other graduation accessories available through Jostens.   XXHS will be responsible for ordering caps and gowns in bulk, saving you a couple dollars.  Students are permitted to re-use their sibling’s black cap and gown. 
If you have not already done so, please make a check payable to XXHS for $23.85 to purchase the cap and gown and turn it in to XXXXXXX, senior class advisor.  We would like to have all payments collected by December 21, 2010.  Please call XXXXXX at 301-XXX-XXXX if you have any questions. ...The right of free access also prohibits mandated purchases of materials, supplies, equipment or uniforms associated with the activity, as well as the payment of security deposits for access, participation, materials or equipment. Finally, a process that allows for a waiver process for an otherwise mandatory fee, charge or deposit does not render it constitutionally permissible.”...
...Teachers’ syllabi regularly list required course supplies, including calculators for mathematics courses and cameras for photography classes. ASB and student stores have become clothing stores selling physical education uniforms which some schools require students to purchase.
In order to comply with the law, these practices will have to cease.
Other school districts nationwide – like this one in Gaithersburg, Maryland – are also confronting similar challenges...

Montgomery County's Letter to State Board

Letter from Montgomery County Executive Leggett and Montgomery County Council President Andrews to Maryland State Board of Education requesting Maintenance of Effort waiver.
