Breaking: AGAIN! MD State Board of Education ORDERS MCPS Board of Ed. to Comply with Appellate Court of MD Order to Review $168M Elec. Bus Contract Award

The Montgomery County Board of Education has still not complied with the March 2024, Maryland Appellate Court Order that mandated the Board of Education review the award of the electric school bus contract to a vendor that had a subcontractor that was found to be involved in an embezzlement scheme with 2 of the 3 MCPS employees that ranked the bids.

On Tuesday, February 25th, the Maryland State Board of Education once again issued an Order to the Montgomery County Board of Education to comply with the Maryland Appellate Court Order. 

The BOE's electric school bus contract is an $168 million dollar award that commits the BOE to a leasing scheme for 16 years There is a lot of money involved in this scheme.  It should be important to get this right. 

And complying with a Court Order would be a good idea too.

Former MCPS Teacher Pleads Guilty to Felony Theft from Rockville Dance Studio

Erin Kelly, a former Montgomery County Public Schools (MCPS) teacher, pled guilty Tuesday to theft of more than $100,000.

She also pled not guilty embezzlement, a misdemeanor. The theft charge is a felony.

The Rockville resident is scheduled to be sentenced on Jan. 7. She could be sentenced to up to 20 years and a $25,000 fine.

Kelly, 41, has been on leave from her position as an Odessa Shannon Middle School team leader for alternative programs, following her indictment by a grand jury for allegedly embezzling $161,000 from a dance studio in Rockville...

One question about the perception of MCPS spurred conversations around student and school performance and the reason for declining trust in the district.  

Harris blamed unfavorable perceptions of MCPS on only bad news being reported, noting the school system is struggling with similar challenges that other districts also are facing, like the increased needs of students that require more educational resources.  

“We are very honestly struggling to meet the needs of the current generation of learners,” Harris said. “This is a school system that is still trying to catch up to reality.”  

Diaz said she would empower all teachers to give students the grades they deserve and eliminate grade inflation.  

Evans said the district and board members needed to be out in the community more so people can understand what’s going on in the district. “We have some wonderful legislators that have put forth [the Blueprint for Maryland’s Future] that is going to allow us to ensure that our teachers are paid more,” said Evans, noting the 2021 landmark education reform legislation passed by the Maryland General Assembly. 

Montoya said she still believed in the quality of the school district but added that test scores and safety incidents are creating concerns among families.  

“So I think that when we talk about addressing these issues, what we’re talking about is rebuilding that trust,” Montoya said. “[To] spend wisely, invest in proven approaches, to close the gap and have a healthy balance between mental health support and adequate law enforcement coverage.”..

O. Shannon Middle School Team Leader on Leave Following Indictment for Embezzlement

Erin Kelly is on leave from her position as an Odessa Shannon Middle School team leader for alternative programs, following her indictment by a grand jury for allegedly embezzling $161,000 from a dance studio in Rockville.

Kelly is listed with Montgomery County Public Schools (MCPS) as “unassigned” as she doesn’t have a physical location in the school system, according to a district spokesperson.

According to the indictment, Kelly is charged with stealing $161,986 between Jan. 1, 2017 and May 31, 2022 from the Dawn Crafton Dance Connection in Rockville.  Grand jurors believed that Kelly “fraudulently and willfully” stole the money “while acting in the capacity of fiduciary.”..

We are writing today with grave concerns regarding recent incidents involving the malfunctioning of school buses within our district. As a collective, we feel compelled to bring these issues to your attention and demand immediate action to address them.

On Friday May 3rd, 2024, students at Westland Middle School riding bus 1113 were subjected to a terrifying, traumatizing and nearly disastrous safety situation.
The engine in the rear of the bus malfunctioned causing eight gallons of highly pressurized antifreeze to be poured and aerosolized around the entire cabin, saturating everyone's clothing, backpacks, and contacting skin and eyes.


The main ingredient of antifreeze, ethylene glycol, is a toxic alcohol. It can cause chemical burns and can cause kidney failure and death if as little as two teaspoons are swallowed.
Firefighters used a low pressure fire hose to decontaminate all of the kids.

They said we were very lucky that the engine had not been running for longer, because superheated antifreeze would have resulted in thermal burns and a Mass Casualty Incident.
The children arrived to school tardy, soaking wet, with their possessions in biohazard bags.

The safety and well-being of our children should be paramount, and it is unacceptable that such incidents are occurring within our school transportation system.

Furthermore,  the same bus was utilized for transportation in the afternoon-- despite children reporting a smell on the bus, and seats and floors that were still wet and sticky.
 
This demonstrates a lack of oversight and accountability within the transportation department, putting the children at risk of further harm.

Regrettably, the problems persisted into the following school day, Monday May 6th, when the same buses broke down again, causing children to be late for school once more. These recurring malfunctions highlight systemic failures in maintaining the safety and reliability of our school buses, and they cannot be overlooked or dismissed.

It is imperative that immediate action is taken to address these serious maintenance and safety concerns within our school transportation system. As concerned parents, we demand the following actions be taken:

1. A thorough investigation into the maintenance protocols and procedures for school buses, with a focus on identifying and rectifying any deficiencies.
2. Immediate inspection of all buses in operation to ensure they meet safety standards and are fit for transporting students.
3. Implementation of a robust system for monitoring and reporting bus maintenance issues, with clear protocols for addressing them promptly.
4. Transparent communication with parents regarding any incidents or concerns related to school bus safety, including updates on corrective actions taken.

Our children deserve to travel to and from school in a safe and secure environment, and it is the responsibility of Montgomery County Public Schools to ensure that this fundamental expectation is met. We urge you to take decisive action to address these issues and prioritize the safety of our students above all else.

We look forward to your prompt response and the concrete steps that will be taken to address these urgent concerns. Thank you for your attention to this critical matter regarding our children's safety.

Former MCPS Transportation Director Todd Watkins Sentenced to Probation.

Todd Watkins, the former Montgomery County Public Schools Department of Transportation director, was sentenced Wednesday to 200 hours of community service and will serve three years of supervised probation.

Watkins previously pled guilty to taking advantage of his position as a public official and stealing funds.

Watkins, 56, faced probation to six months in prison for pleading guilty to one count of misconduct.

According to court records, Watkins failed to properly manage the contract for school bus purchases and the use of purchasing cards, enabling Assistant Director of MCPS Department of Transportation Charles Ewald to steal more than $320,000...

  • Following the successful restructuring of the company's convertible notes earlier this year, the move comes as a surprise.
  • Apparently, the company is looking to separate the legacy transit bus operations from the battery and charging solutions segment ("Proterra Powered & Energy") and pursue a recapitalization or sale.
  • Regardless of the company pursuing a recapitalization or a sale, a recovery for existing equity holders looks highly unlikely at this point.

...State’s Attorney information showed that Watkins arranged with Steve Leonard, the president of American Truck & Bus, to keep late fees and change fee reimbursements rather than returning that money to the school system...

...Watkins arranged an “off-the-books” system with the bus company, and the vendor kept a record of money owed to the school system. The company deducted those owed amounts from its payments from the school system; Watkins received about $13,000 from those payments. The former director provided documentation of those payments and is not charged with theft...

Todd Watkins, a former director of transportation for Montgomery County Public Schools, has been charged with misconduct in office.

A pre-indictment plea is set for Friday at 11 a.m.

According to court records, his alleged offense dates back to 2016.

Former MCPS Assistant Director of Transportation Charles Ewald pleaded guilty May 18 to a theft scheme involving more than $100,000 and misconduct in office. He will be sentenced Sept. 6 in Montgomery County Circuit Court.

Ewald, along with Watkins, have been under investigation for using almost $600,000 of MCPS funds for their personal use...

Montgomery County Board of Education members discussed the “difficult choices” they face paying for programs after the Montgomery County Council’s adoption of Fiscal Year 2024 budget.

Montgomery County Public Schools will receive $74.3 million less than it requested.

While MCPS will receive the most money ever from the County Council, it needs additional funds due to increasing enrollment, inflation and salary increases.  MCPS’ FY 2025 budget looks even grimmer as one-time federal grants will expire by then as BOE members stressed at their Thursday business meeting.

“Next year’s fiscal cliff is looming on the horizon,” said Superintendent Monifa McKnight.

Regardless of any fiscal reductions, “We will honor our negotiated contracts, and we will not raise class size,” McKnight vowed. However, she added, “Out of necessity, some things must go.”..

Former MCPS transportation official pleads guilty to felony theft scheme

MONTGOMERY COUNTY, Md. (7News) — A former Montgomery County Public Schools Department of Transportation official pleaded guilty to theft on May 18...

...Recently obtained documents allege Ewald charged more than $460,000 on his MCPS-issued credit card between 2016 and 2022.

Those purchases include gift cards, furniture and items that were allegedly shipped to his home --- not to MCPS.

Other records show Ewald appeared to have paid off a loan for a $64,000 Lincoln Navigator with off-the-books reimbursements...

Montgomery County Executive Marc Elrich today released his recommended Fiscal Year 2024 (FY24) Operating Budget of $6.8 billion, which is an increase of 7.7 percent from the FY23 approved all funds budget (County Government plus outside agencies.) Report: MCPS’ Department of Transportation Abused Use of its Credit Cards @mcps @mocoboe

Montgomery County Public School’s Department of Transportation (DOT) abused its use of purchase cards [CREDIT CARDS], according to a 15-page report released Thursday by Montgomery County Inspector General Megan Davey Limarzi.

An earlier internal audit by the school district found “questionable purchases,” including gift cards, furniture, and other purchases that were shipped to an employee’s home.

The Office of Inspector General (OIG) reviewed $570,000 worth of transactions from July 2020 to June 2022 and ruled that $133,000 of these purchases by a former DOT assistant director were prohibited by MCPS policy.

The OIC and MCPS noted that $6,500 was spent on items that were considered not for use by MCPS.

According to the report, “The OIG also found that MCPS DOT management and staff regularly violated MCPS P-Card [CREDIT CARD] policies.”..

State lawmakers were unsparing in their criticism of the Maryland Department of Health on Tuesday, accusing the agency of failing to pursue financial compensation against a vendor that has acknowledged serious shortcomings.

One after another, members of the General Assembly’s Joint Audit and Evaluation Committee expressed astonishment that the agency decided — as a matter of policy — not to seek liquidated damages from Optum, a health claims-processing company whose shortcomings were the subject of a harsh audit last month.

The Minnesota-based firm processes billions of dollars in behavioral health claims each year. The review of Optum’s performance, which was conducted by the Office of Legislative Audits (OLA), uncovered numerous problems.

Auditors discovered more than $220 million in payments for behavioral health services that lacked proper documentation or haven’t been recovered, lapses that prevented the state from receiving nearly $30 million in federal reimbursement for which it was eligible. In addition, mental health providers, who have been stretched thin and subject to burnout since the pandemic began, have been forced to spend long hours reconciling payment errors.

Agency officials gamely sought to reassure lawmakers that they have penalized and withheld payments from Optum, but they acknowledged that they decided not to seek liquidated damages for fear of harming their relationship with the firm. The admission appeared to stun members of the panel.

“I think it sends the wrong message to contractors that work with the state — and makes a laughingstock of our contracting process,” said Sen. Clarence Lam (D-Howard), a committee co-chair. “If we enter into contracts with vendors who are unable to deliver, and yet do not pursue damages when those contractors are costing the state millions of dollars… it’s an example of what’s broken with our state procurement process.”
