Does the plaintiff have to show that harm was done (e.g. kids with cancer, not some future possibility of cancer)? And then can a causal relationship be made that states that the victims could have only contracted their cancer by inhaling the radon found at school (not some other carcinogen found elsewhere)? You can bet that MCPS has already consulted with or assembled an expensive team of attorneys that will fight parents vigorously, if/when children come down with radon-related illnesses... all funded at taxpayer expense.
